Judge: Egg Donor Cory Sause is Boy's Mother--and will get parenting rights

An Oregon judge has ruled that an egg donor mother has the right to be part of her child's life, despite the efforts of the wealthy sperm-donor father who wants to cut her out of the picture. The ruling was based on the "contradictory" agreement that the egg-donor mother and the father signed prior to the birth of a son and emails and other evidence showing that the father intended to keep the mother in his son's life, changing his mind only after the boy was born. In her decision, Judge Amy Holmes in Portland said that she will meet with the parties to develop a parenting plan.

The case does not signal a breakthrough for all egg donors who after birth wish to participate in the resulting child's upbringing, for this case involved an agreement between two parties who were a couple at the time an egg was implanted in a surrogate, and the agreement signed was not cut-and-dried as is usual between parties who do not have a prior relationship. The child, a boy named Samuel, is now two.

I did not want to get pregnant when I did, but once I had my baby I knew doing anything but keeping her was wrong. I knew I would "never get over it." I knew I wanted to keep her and take care of her and watch her grow up and be her mother in every sense of the word.

Now imagine that someone else is trying to force you to become a mother because in a moment of craziness you donated an egg and it was implanted with your boyfriend's sperm, and then frozen away for use (as in birth) at some future time. Then imagine you decided the boyfriend was a creep, broke up with the guy, met and married someone else and now the ex wants to hire a surrogate to nurture the embryos because he wants...your children. Nightmare scenario, right?

Genetic mother denied visitation with son conceived in vitro

Jordan Schnitzer wanted a son without the bother of a mother. After two attempts using "donated" eggs, Schnitzer, 65, the divorced father of two teenage daughters turned to his 37-year-old girlfriend Cory Sause. She happened to have some eggs frozen just in case... and she agreed to share them with Schnitzer. After a surrogate became pregnant from Schnitzer's/Sause's embryo/DNA, their relationship soured.

Their son was born in December and they are now embroiled in litigation on whether egg mother Sause can have visitation with her biological son. Schnitzer's position is absolute: He is the sole and exclusive parent. His name alone is on the birth certificate. Biology be damned.
